Terms of Service

1. Introduction
These terms of service ("Terms") govern your use of the Delicia Pro platform and services ("Service") operated by Delicia Pro ("we", "us", "our"). By subscribing to or using our Service, you agree to be bound by these Terms.
Delicia Pro provides software-as-a-service (SaaS) platforms specifically designed for pet service businesses, including dog groomers, dog walkers, and pet sitters.
2. Service Description
We offer three subscription tiers per service type, each providing different levels of functionality:
- Web (£9.99/month): A professional 6-page website with legal pages, cookie policy, schema markup, and a small backend for managing your logo, colours, and staff page.
- Booking (£19.99/month): Everything in Web plus a booking system integrated with Google Calendar and a backend for managing bookings.
- Suite (£29.99/month): Everything in Booking plus a full CRM and booking platform, insights and blog system, Fill My Diary SMS campaigns, kiosk mode, digital grooming records, referral programme, and no restrictions on staff, services, or commission tracking.
Each tier is available for salon groomers, mobile groomers, dog walkers, and pet sitters as a dedicated platform built specifically for that service type.
3. Subscription and Billing
By subscribing to our Service, you agree to the following billing terms:
- All plans include a free first month. No payment is taken until the second month.
- There are no setup fees and no long-term contracts.
- Subscriptions are billed monthly in advance via Stripe.
- You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
- We do not offer refunds for partial months of service.
- We reserve the right to change pricing with 30 days' written notice. Existing subscribers will be notified before any price change takes effect.
4. SMS Usage and Billing
If your subscription tier includes SMS features (such as Fill My Diary, appointment reminders, or marketing campaigns), the following terms apply:
- SMS messages are billed at 10p per message, in addition to your monthly subscription fee.
- SMS messages are delivered via Webex and are subject to Webex's acceptable use policy.
- SMS usage is billed monthly in arrears and added to your subscription invoice.
- You are responsible for ensuring that recipients have consented to receive SMS messages from your business, in compliance with UK data protection and electronic communications regulations.
- We are not liable for undelivered messages caused by network issues, incorrect phone numbers, or carrier filtering.
5. Your Account
You are responsible for:
- Maintaining the security and confidentiality of your account credentials
- All activity that occurs under your account
- Ensuring that the information you provide is accurate and up to date
- Notifying us immediately if you suspect any unauthorised access to your account
6. Data Ownership
Your data belongs to you. Specifically:
- You retain full ownership of all data you input into our platform, including client records, booking data, pet profiles, and business information.
- We host your data on our servers and process it solely to provide the Service to you.
- We will not sell, share, or otherwise disclose your data to third parties except as required to provide the Service (e.g. payment processing via Stripe, SMS delivery via Webex, email delivery via Postmark).
- Upon cancellation or termination, you may request a full export of your data. We will provide your data in a standard machine-readable format within 30 days of your request.
- We retain your data for 90 days after cancellation to allow for reactivation. After 90 days, your data will be permanently deleted unless you request an earlier deletion.
7. Platform Uptime
We strive to maintain high availability of our Service. While we do not guarantee 100% uptime, we commit to:
- A target uptime of 99.9% measured on a monthly basis, excluding scheduled maintenance
- Providing advance notice of scheduled maintenance where reasonably possible
- Scheduling maintenance outside of peak business hours (typically between 1am and 5am GMT)
- Communicating promptly about any unplanned downtime or service disruption
8. API and Integrations
Where our platform provides integrations with third-party services (such as Google Calendar), the following terms apply:
- Third-party integrations are provided on an "as available" basis and may be subject to the third party's own terms of service.
- We are not responsible for changes, outages, or discontinuation of third-party services that may affect integrations.
- You are responsible for maintaining valid credentials and permissions for any third-party accounts connected to our platform.
9. Acceptable Use
You agree not to use our Service to:
- Violate any applicable laws or regulations
- Send unsolicited or spam communications via SMS or email
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use the platform for any purpose other than managing your pet service business
- Resell, sublicense, or redistribute access to the Service without our written consent
10. Intellectual Property
All intellectual property rights in the Service, including software, design, branding, and documentation, belong to Delicia Pro. Your subscription grants you a non-exclusive, non-transferable licence to use the Service for the duration of your subscription.
11. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability to you in any twelve-month period shall not exceed the total subscription fees you have paid to us in that period.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
- We are not liable for any loss of data, revenue, or business opportunity arising from service interruptions or data loss, provided we have met our obligations under these Terms.
12. Cancellation and Termination
You may cancel your subscription at any time through your account dashboard or by contacting us. Upon cancellation:
- Your subscription remains active until the end of your current billing period.
- You may request a data export at any time before or after cancellation.
- Your data is retained for 90 days post-cancellation, after which it is permanently deleted.
- Any outstanding SMS charges will be billed in your final invoice.
We may terminate or suspend your account if you breach these Terms, fail to pay subscription fees, or use the Service in a way that harms other users or our infrastructure.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
